How Fiancee Visas Work:
International
romance has become easier and easier with
emails, instant chat, inexpensive long distance telephones and cheap
airfares.
More easily than ever before men and women can
“meet” and fall in love, even
while being separated by thousands of miles.
The
fiancée visa is a wonderful idea. Its purpose and
sponsorship by the U.S.
government is to provide couples 90 days together in America
to get to know each other
better so they can make an informed decision on whether they should
marry. Not
only can this time be used to confirm whether they are compatible as a
couple,
but also to confirm whether the fiancée can be comfortable
with and accept the
sponsors family, friends, coworkers, lifestyle and environment. She
must decide
if she can adjust to living in America,
far away from her family, friends, culture and country.
The
K1 visa or Fiancee Visa when issued allows your foreign
Fiancée permission to enter the United States
to marry you. Once she enters the United States
she has 90 days before the visa expires. During that time she must
either marry
you, or return home.
The
process begins when the Sponsor submits a package of
application formsknown
as the Fiancee
Visa package to USCIS. The
package
generally consists ofthe
visa
application biographical
background
forms, and supporting documents photos, certificates etc. The documents submitted are
examined by USCIS
personnel and may at this stage be denied if the application has not
been
properly completed, documents are missing, or any of the eligibility

the application is approved, it is then passed on to

lives. There the consular officers conduct their own investigations
confirming the
fiancées situation and the authenticity of the Fiancee Visa
application.
Once
the application package arrives consulate officials
contact the Fiancée mailing her a package of forms and
instructions. These
instruct the Fiancée what documents such as police reports,
support affidavits
and so on are required by that consulate. After the fiancée
completes this step,
the consul arranges a medical exam for a physical, and schedules an
interview with
the fiancée. At the interview the Fiancee must verify the
nature and sincerity
of the relationship and confirming that a legitimate marriage is the
objective. I will help
your fiancee fill in these forms, and prepare for her interview.
Providing
documentation is in order, the medical examination
has not revealed any major health concerns, and the interview went
well, the
Fiancee will be approved for the K1 visa. The visa will be stamped in
her
passport that day or within a few days depending on the procedures at
the
consulate.Once the
visa is stamped into
her passport she has 6 months to begin her travel to the U. S. Once she arrives she has 90
days, to either
marry or leave the country.
If
the fiancée marries within the 90 days, before her visa
expires, she must apply to USCIS, for an Adjustment of Status. This is
to
modify her status from that of a visitor on a K1 visa, to a conditional
permanent resident. Another interview is held, this time with a USCIS
officer
to confirm that the marriage is legitimate. If you
need help in applying for the Adjustment of Status, I also

Finally,
21 months later, within 90 days before the second
year anniversary of the granting of her conditional permanent residency
status
the Fiancee (now wife) must applyto
have the conditional status lifted. Failure to do so, she may be liable
for
deportation.
After three years of
residing with the Sponsor as his wife
she can apply to become a US
citizen.

Don’t try to get a waiver to avoid the requirement to meet your Fiancee in person. Unless it is incontrovertible that you are not physically able to meet her, attempting to avoid the meeting reflects poorly on whether the relationship is truly sincere. The Fiancee Visa eligibility rules require that you have met your Fiancee in person within the two years prior to your filing your application. The regulations provide a loophole allowing a waiver to the physical meeting. This waiver has been written to allow couples with special circumstances to skip the meeting, specifically if the meeting will cause “unusual hardship” or violates strict cultural or religious practices. If your religion arranges marriages and the bride and the groom are not allowed to see each other till the wedding day, or if you are in an iron lung, then by all means apply for the waiver. However, hating to fly or not wanting to pay for a plane ticket or having a busy work schedule will not result in the waiver being granted. Remember, USCIS needs to be convinced of the seriousness and sincerity of your relationship in order to approve the visa application. One expects a sincere suitor eagerly anticipating spending his future life together with his Fiancee to not miss any opportunity to meet and be with her as early and as often as possible.
